LaBar & Adams has been named class counsel in a state wide collective action filed in the Federal Middle District of Florida representing a class of employees against their current/prior employer.
On June 11, 2015 LaBar & Adams filed a collective action lawsuit on behalf of all current and former Laborers and Drivers that worked for M & M Asphalt Maintenance, Inc. and All County Paving, Inc. in the State of Florida during the preceding three (3) years. The lawsuit was filed pursuant to the Fair Labor Standards Act (“FLSA”) seeking unpaid overtime owed to the class of employees.
On July 5, 2016, Federal District Judge Roy B. Dalton, Jr. certified two classes. The first class consisted of Laborers that:
- Worked for M & M Asphalt Maintenance, Inc. during the preceding three years;
- Were paid an hourly rate;
- Did not receive pay for drive time;
- Worked more than forty hours in a work week without being paid overtime compensation.
The second class consisted of Drivers that:
- Worked for M & M Asphalt Maintenance, Inc. during the preceding three years;
- Were paid an hourly rate;
- Had a lunch automatically deducted from their pay even though one was not taken or interrupted;
- Worked more than forty hours in a work week without being paid overtime compensation.
