USERRA: Uniformed Services Employment and Reemployment Rights Act: Discrimination

USERRA (Uniformed Services Employment and Reemployment Rights Act) was enacted by Congress to protect military veterans. The purpose of USERRA is to:

  1. Encourage non-career military service by eliminating or minimizing the disadvantages to civilian careers
  2. Minimize the disruption of servicemembers and their employers by providing for the prompt reemployment of servicemembers
  3. Prohibit discrimination against servicemembers.

USERRA provisions are interpreted in favor of military service members as its purpose is to protect such members.

USERRA protects against discrimination, retaliation, and provides the right of reemployment after the completion of military service. USERRA entitles a returning servicemember to reemployment rights and benefits provided by USERRA if the person meets reemployment-eligibility criteria enumerated under the statute. No showing of discriminatory or retaliatory intent is necessary to establish a violation of the right to reemployment.

USERRA protects those who selflessly give much to our community.  Having had served in the military, the employment attorneys at LaBar & Adams know firsthand the difficulties that arise to those that hear the calling.  We are proud of our service and take personal pleasure helping our fellow servicemen and service woman with their employment issues.
