USERRA: Uniformed Services Employment and Reemployment Rights Act: Discrimination

USERRA (Uniformed Services Employment and Reemployment Rights Act) was enacted by Congress to protect military veterans. The purpose of USERRA is to:

  1. Encourage non-career military service by eliminating or minimizing the disadvantages to civilian careers
  2. Minimize the disruption of servicemembers and their employers by providing for the prompt reemployment of servicemembers
  3. Prohibit discrimination against servicemembers.

USERRA provisions are interpreted in favor of military service members as its purpose is to protect such members.

USERRA – PROTECTIONS

USERRA protects against discrimination, retaliation, and provides the right of reemployment after the completion of military service. USERRA entitles a returning servicemember to reemployment rights and benefits provided by USERRA if the person meets reemployment-eligibility criteria enumerated under the statute. No showing of discriminatory or retaliatory intent is necessary to establish a violation of the right to reemployment.
