The Pregnancy Discrimination Act protects the rights of pregnant women in the workplace. It establishes that discrimination by employers on the basis of childbirth, pregnancy or related medical conditions are unlawful under the law. Employers cannot discriminate based on childbirth, pregnancy or related medical conditions when it comes to any aspect of employment, to include: hiring, firing, pay, job assignments, promotions, layoffs, fringe benefits, or any other term or condition of employment.

Pregnant employees must be allowed to continue to work as long as the employee can continue to perform her job. If a pregnant employee is unable to perform her job because of the pregnancy, the employer must treat her the same as any other temporarily disabled employee. For example, providing reasonable accommodations such as alternative assignments, light duty, or possibly leave without pay.

Pregnant employees are also protected from retaliation when they make a complaint to management regarding being discriminated because of being pregnant. Pregnant employees are also protected from retaliation for engaging in any of the following regarding pregnancy: filing a charge, a lawsuit, testifying, assisting, or participating in any manner in an investigation, proceeding or hearing regarding pregnancy discrimination.

If it is determined that an employee has suffered from pregnancy discrimination, the employee may recover back pay, front pay, lost benefits, damages for pain and suffering, punitive damages, and attorney’s fees and cost.

Also, pregnant employees will have additional rights under the Family Medical Leave Act (“FMLA”).
