LaBar & Adams, P.A. was appointed class counsel in the Middle District of Florida. The employees consisted of forty-two (42) drivers employed by Bobcat North America, LLC d/b/a Orion Waste Solutions.
These employees alleged that they were victims of two defacto policies that resulted in them not receiving proper overtime wages in violation of the FLSA. First, the employees contended that Orion Waste “shaved” time from their time records to reduce overtime pay and payroll expenses. Second, the employees contended that Orion Waste automatically deducted a half-hour lunch from their time when Orion Waste knew or should have known that the employees were not receiving a bonafide meal break.
This case was aggressively defended. LaBar & Adams was able to uncover over 24,000 pages of data and other records that were relevant to the defacto policies including payroll records, time records, time-stamped “Idle-Time” reports, and GPS reports. Ultimately, Orion Waste agreed to pay the forty-two (42) drivers $542,093.13 in unpaid overtime, liquidated damages, and attorney’s fees and costs.
