Protecting Employee’s Civil Rights

The foundation of our civilization is based upon the major premise that “[f]or unto whosoever much is given, of him shall be much required.” See Luke 12:28 (KJV). With power comes responsibility. Unfortunately, employers and supervisors abuse their power. Sometimes supervisors abuse their power to obtain sex. The Employment Lawyers at LaBar & Adams recently litigated a Civil Rights case in Federal Court that demonstrated such an abuse of power that treaded upon the sanctity of the fundamental rights protected under the Florida Civil Rights Act. The right to be free from sexual abuse, harassment, and discrimination. Such abusive practices have been condemned by the citizens of Florida. “Florida has opted for a strong policy against sexual harassment in the workplace.” See Speedway SuperAmerica, LLC v. Dupont, 933 So. 2d 75 (Fla. 5th DCA 2006).

This case was aggressively litigated for almost two years. There were well over ten depositions taken. There were numerous motions filed to include motions to compel discovery, motion for summary judgment, Daubert motions, and motions in limine. The employer engaged in a “war of attrition” strategy. But our highly experienced Employment Lawyers were able to overcome summary judgement and proceeded full speed to trial. On the eve of trial, the Employment Lawyers at LaBar & Adams were able to receive a settlement that fully satisfied our client’s desire to right the wrong endured.
